Consumer Health Data Privacy Policy

This policy supplements our Privacy Policy and applies to personal information that may be considered "consumer health data" under Washington's My Health My Data Act, Connecticut's consumer-health-data provisions, Nevada's health data privacy law, and similar laws.
Gest is not a healthcare provider, health plan, healthcare clearinghouse, HIPAA covered entity, or HIPAA business associate. Gest is a surrogacy companion app. Because surrogacy can involve pregnancy, fertility, medical, and reproductive-health information, we treat this data with special care.
1. Categories of consumer health data we collect
Depending on how you use Gest, we may collect the following categories of consumer health data:
- Surrogacy journey details, such as role, journey phase, due date, state, and milestone status.
- Pregnancy, fertility, reproductive-health, or medical details you choose to enter.
- Doctor visits, appointments, checklists, medications, birth-plan details, and post-birth tasks.
- Documents you upload, such as contracts, medical records, insurance records, or legal paperwork.
- Messages, photos, notes, or AI companion conversations that reveal health or reproductive information.
- Inferences we make from your inputs to personalize recommendations, such as journey stage or upcoming tasks.
2. Sources of consumer health data
We collect consumer health data from:
- You, when you create an account, complete onboarding, upload content, or use app features.
- Other journey participants, such as an invited intended parent or gestational carrier, when they share content with you.
- Your device or app usage, such as feature usage and crash diagnostics, when that information relates to the service.
- Documents or records you voluntarily upload. We do not pull medical records directly from providers.
3. Why we collect and use it
We collect and use consumer health data only as reasonably necessary to:
- Provide the Gest app and requested features, including shared spaces, checklists, calendars, documents, and AI companion responses.
- Personalize recommendations based on your journey phase, state, due date, and preferences.
- Translate messages when requested by users who speak different languages.
- Maintain, secure, debug, and improve the service using aggregated or de-identified analytics where practical.
- Respond to privacy, deletion, support, security, or legal requests.
4. How we share consumer health data
We do not sell consumer health data. We do not share consumer health data with data brokers, advertisers, or employers. We do not use consumer health data for targeted advertising.
We may share consumer health data only in the following limited ways:
- With service providers that process data for us, such as Supabase, Google Gemini, Google Cloud Translation, PostHog, Loops, Vercel, Resend, and RevenueCat.
- With other journey participants when you choose to share messages, photos, documents, or other content with them.
- With app-store providers for subscription status, payment validation, and app distribution.
- With authorities or other parties only when required by valid legal process or to protect rights, safety, and security.
We have no affiliates with whom we share consumer health data. If that changes, we will update this policy before sharing consumer health data with an affiliate.
5. Advertising, analytics, and geofencing
Meta Pixel and Google Ads conversion tracking may be used on selected marketing pages. Those tags load only after cookie consent and are not used to send consumer health data, messages, documents, AI conversations, account-deletion tokens, or authentication tokens to advertising platforms.
We do not use geofencing around healthcare facilities, reproductive-health facilities, fertility clinics, surrogacy agencies, or similar locations to identify, track, advertise to, or collect consumer health data from consumers.
6. Your rights
Depending on where you live, you may have the right to:
- Confirm whether we collect, share, or sell consumer health data about you.
- Access your consumer health data, including a list of third parties and affiliates with whom it was shared or sold.
- Withdraw consent for future collection or sharing of consumer health data.
- Request deletion of consumer health data from our systems and from processors where required by law.
- Appeal a denied request where applicable law provides an appeal right.
To exercise these rights, email hello@thegest.app. We may need to verify your identity before fulfilling a request. You do not need to create a new account to submit a request.
